Terms of Service

1. Agreement to Terms

By downloading, signing in to, or using the App, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. These Terms apply to every device on which you use the App, including your iPhone and Apple Watch. If you are using the App on behalf of an organization (for example, a league or club), you represent that you are authorized to accept these Terms on its behalf.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian, and by using the App you represent that such consent has been obtained. You also agree to comply with the Apple Media Services Terms and Conditions, which apply to apps downloaded from the App Store.

3. Your Account

HyperScore uses Sign in with Apple to create and secure your account. You are responsible for maintaining the confidentiality of the Apple ID associated with your account and for all activity that occurs under it. You agree to:

• provide accurate information and keep it up to date;
• choose team names, display names and custom labels that are not misleading, offensive or unlawful;
• notify us promptly at usehyperscore@gmail.com if you believe your account has been compromised.

You may not transfer your account to anyone else or create an account on behalf of another person without their permission.

4. What the App Does

HyperScore is a scorekeeping app for racket and court sports. Depending on your plan, the App lets you:

• keep score for two-team and multi-team matches (up to eight teams) and score from your Apple Watch, with your iPhone scoreboard kept in sync;
• use built-in sport templates — including volleyball, beach volleyball, badminton, squash, table tennis, pickleball, padel and basketball — plus a Freeplay mode and custom templates you build yourself;
• apply scoring rules such as win-by-two, set-based win conditions, sudden-death caps and serve tracking, and see on-court indicators like the lead crown and set and serve markers;
• customize team names, colors, themes and sound profiles, and review a per-session match history.

Your account data — such as your custom templates, team settings and match history — is stored and synced across your devices through services we operate so it stays consistent wherever you sign in.

About scoring: HyperScore's rule presets and scoring logic are provided as a convenience and may not match the official rules of every league, tournament or governing body. You are responsible for confirming the official score and outcome of any match. HyperScore is not affiliated with, or endorsed by, any sport's governing body.

5. Free Plan, Pro & Purchases

The App's Freeplay mode is free to use. Unlocking the full set of sport templates and Pro features requires HyperScore Pro, which is offered as both an auto-renewing subscription and a one-time lifetime purchase. We may also provide a limited number of free daily tokens that let you try locked templates before buying.

• Billing. All purchases are processed by Apple through your Apple ID and are governed by Apple's payment and refund policies. Prices are shown in the App before you confirm a purchase.
• Auto-renewal. A subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription anytime in your Apple ID's Subscriptions settings; cancelling stops future renewals but does not refund the current period.
• Lifetime unlock. A one-time lifetime purchase unlocks the included Pro features for as long as the App is reasonably supported on your account. It is not a subscription and does not renew.
• Free tokens. Tokens are a limited, revocable license to access a template temporarily. They have no cash value, cannot be transferred or redeemed for money, and may expire or reset on a recurring basis.
• Refunds. Except where required by law, purchases are non-refundable. Refund requests for App Store purchases are handled by Apple.
• Price changes. We may change prices or the features included in a plan. Changes to a recurring subscription price will be handled in accordance with Apple's rules, including any required notice and consent.

6. Your Content & Data

You keep ownership of the content you create in the App, such as custom templates, team names and colors, and match records ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, sync and display Your Content solely to operate and provide the App to you across your devices.

You agree not to enter content that is false, infringing, harassing, hateful, obscene or otherwise unlawful — including in free-text fields like team or display names. We may remove content that violates these Terms.

7. Acceptable Use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorized access to the App, other users' accounts, or our systems;
• copy, modify, reverse engineer, decompile or disassemble the App, except to the limited extent permitted by law;
• use bots, scrapers or other automated means to access the App, or interfere with its normal operation;
• circumvent, disable or tamper with purchase, subscription, token or licensing controls;
• impersonate any person or misrepresent your affiliation with anyone.

8. Reporting Problems

If you encounter content or behavior that violates these Terms, or you run into a problem with the App, contact us at usehyperscore@gmail.com. We review reports at our discretion and may take action we consider appropriate.

9. Termination

You may stop using the App at any time and may delete your account, which removes the account data we hold for you as described in our Privacy Policy. We may suspend or terminate your access to the App, with or without notice, if you violate these Terms or use the App in a way that could harm us or other users. If your account is terminated for a violation, you may not create a new one without our permission.

Subscriptions are managed through your Apple ID; deleting your HyperScore account does not by itself cancel an active App Store subscription. Cancel it in your Apple ID's Subscriptions settings to stop future charges.

10. Disclaimers

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or perfectly accurate, that scores or rule outcomes will match official results, or that data will always sync without delay or loss. You rely on the App's scoring at your own discretion and should confirm official results independently.

11. Limitation of Liability

To the fullest extent permitted by law, HyperScore will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, goodwill or profits, arising out of or relating to your use of (or inability to use) the App — including any reliance on scores, rule presets or match data. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim or US $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Apple App Store Terms

The following applies because the App is distributed through Apple's App Store. These Terms are between you and HyperScore only, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. If a third party claims the App infringes their intellectual property, HyperScore — not Apple — is responsible for any such claim to the extent required by these Terms. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will let you know within the App or by other reasonable means and update the "Last updated" date above. Your continued use of the App after changes take effect means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in California, to the extent permitted by applicable law.
